Bill 14005 does not create any new grounds for foreclosure of housing

Bill 14005 digitalizes enforcement proceedings: after paying the debt, citizens are automatically removed from the register of debtors, and the grounds for foreclosure of housing remain unchanged.

The European integration bill No. 14005, adopted in the first reading on November 4, became an important step in the digitalization of enforcement proceedings in Ukraine. Its main goal is to simplify processes for citizens and reduce the burden on state bailiffs, without changing the current rules for foreclosure of housing.

As Deputy Minister of Justice Andriy Gaichenko said, the key innovation of the law is the automatic exclusion of a person from the Unified Register of Debtors immediately after the debt is paid in full. This means that citizens no longer have to look for their bailiff or wait for his actions to remove encumbrances from property.

“The only thing that the bill introduces is the automatic exclusion of a person from the register of debtors after the debt is paid. Thus, you paid – and you are free in all your rights. You do not need to look for a state bailiff. This is especially relevant for internally displaced persons: if you live in Lviv, and your bailiff – in Kherson or Mykolaiv region, and also went on sick leave or resigned. How will you find him so that he presses the button, although you have already paid everything? This is exactly the simplification that this bill is about,” Andriy Gaichenko noted.

He also emphasized that the bill does not create any new grounds for foreclosure of housing. An apartment or other property can be seized only in cases clearly stipulated by law, for example, if the amount of debt exceeds 160 thousand hryvnias. This procedure remains unchanged.

The digitalization of enforcement proceedings will allow state bodies to promptly update the status of debtors who have already paid their obligations, and will make the work of the service more transparent and convenient for citizens. In the future, this should significantly simplify the interaction between the state and people who have fulfilled their financial obligations, without unnecessary bureaucracy.

Draft Law No. 14005 is part of Ukraine’s obligations under the Ukraine Facility Plan and meets European integration standards designed to ensure transparency and efficiency of the implementation process.
