When can an employer recall an employee from vacation?

Sometimes the employer may ask the employee to return to work earlier than the established period. In such cases, it is important to know your rights. This is reported by the North-Eastern Interregional Department of the State Labor Service.

Withdrawal from annual leave is possible only with the employee’s consent and exclusively in cases specified by law.

In particular, this is allowed for:

prevention of a natural disaster or industrial accident and elimination of their consequences;
prevention of accidents or downtime;
prevention of death or damage to the enterprise’s property;
other cases provided for by law.

In the event of an employee’s withdrawal from leave, his work is paid taking into account the amount accrued for the unused part of the leave.

It is worth noting that return from leave must always be based on the employee’s voluntary consent and compliance with labor legislation.
