The right to an insurance pension in Ukraine depends on the insurance experience acquired by a person. After January 1, 2004, when the Law of Ukraine “On Compulsory State Pension Insurance” came into force, the experience is calculated according to the data of the register of insured persons of the State Register of Compulsory State Social Insurance. For periods of work before this date, the main document is the work book issued upon first employment.
The PFU explained that in the event of loss of the work book, absence of entries in it or presence of incorrect or inaccurate data, the experience until 2004 can be confirmed in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated 12.08.1993 No. 637. The following documents are used for this:
data from the register of insured persons of the State Register of Compulsory State Social Insurance;
extracts or certificates drawn up, in particular, on the basis of data from information or information and communication systems of enterprises, institutions, organizations;
personal accounts and information on the issuance of wages;
certificates, characteristics, written employment contracts with marks on their execution and other documents containing information on periods of work;
trade union membership cards with marks on the payment of contributions.
If the necessary data is not in the register, and the enterprise, institution or organization is located in a temporarily occupied territory, in a combat zone or in territories that were under occupation, and their documents were destroyed or damaged due to the war, the length of service can be confirmed by the testimonies of at least two people. These witnesses must:
know the applicant through joint work at the same enterprise, institution, organization or in the same system;
have documents confirming their own work for the period that they certify for the applicant.
If the work book exists, but contains corrections or inaccurate records of work at enterprises located in the temporarily occupied territories of Donetsk, Luhansk regions, the Autonomous Republic of Crimea or the city of Sevastopol, the length of service is confirmed by special Commissions on issues of confirmation of work experience. Such commissions were created at each main department of the Pension Fund of Ukraine in the regions and the city of Kyiv, in accordance with the resolution of the PFU Board of Directors dated 10.11.2006 No. 18-1.
