What assets are never inherited by descendants?

Many people do not know that along with the inheritance, you can receive not only property, but also the debts of a deceased relative. Therefore, before accepting an inheritance, lawyers advise you to carefully check all the circumstances so as not to be left with only financial obligations. The Civil Code of Ukraine states that Ukrainians cannot bequeath to their children.

What is not included in the inheritance

According to Article 1219 of the Civil Code of Ukraine, not all rights and obligations of the deceased are inherited. Some of them are closely related to the person’s personality and cannot be transferred to others. In particular, the following cannot be inherited:

Membership in public or professional organizations, as well as participation in societies.
Personal non-property rights – honor, dignity, the right to privacy, personal inviolability, etc.
Compensation for damage to health caused by injury or disability, because such payments are purely personal.
Rights and obligations as a creditor or debtor that terminate upon the death of a person (Article 608 of the Civil Code).
The right to alimony, pension, social benefits or assistance provided to a person for his personal support.

What else cannot be inherited

According to Stanislav Borys, managing partner of the VIDAR Law Firm, in Ukraine you can inherit almost everything that belongs to a person on legal grounds – real estate, transport, jewelry or personal belongings. However, there are restrictions.

“If suddenly your grandfather has a German howitzer from the Second World War in his garage that has not been properly registered – then he will not be able to register it as an inheritance, because this is prohibited,” the lawyer emphasizes.

Therefore, before accepting an inheritance, it is worth making sure that the property really belonged to the testator legally, and also check whether he left behind any outstanding debts.
