The Pension Fund appeals all court decisions: why pensioners’ cases take years to be considered

The situation with the consideration of pension cases in Ukraine

As reported by Khvylia: The Pension Fund of Ukraine appeals almost all court decisions in pension cases, which has led to a significant increase in the burden on the courts and an extension of the terms of consideration of cases. The Fund files appeals in almost 100% of cases, which has caused a significant burden on the courts of appeal. As a result, the terms of consideration of cases have significantly increased, and some judges even consider cases for a year or a year and a half.

The Pension Fund of Ukraine has been allocated significant funds to pay court fees for appeals. However, the fund often files complaints without paying the court fee, which also affects the process. The court gives a period to eliminate the shortcomings, after which the proceedings are opened. As a result, the terms of consideration of cases have increased many times, and cases in the appellate instance can be considered for 5 months, six months or even more.

Court workload and its impact on citizens

The Kyiv District Administrative Court is the busiest in Ukraine. The appellate panel consists of three judges, which also affects the length of case consideration. Judicial practice remains on the side of pensioners, which emphasizes the importance of this issue for citizens.

“Cases can be considered for 5 months, six months, and sometimes even more,” said Tetyana Golytsya, emphasizing the seriousness of the situation.

The situation with pension case consideration in Ukraine indicates systemic problems in the judicial system that require urgent resolution. High court workload and delays in case consideration can negatively affect the well-being of pensioners waiting for justice. Given the importance of timely receipt of pension payments, the problem of delaying proceedings can become a subject of public discussion and demands for reform of the judicial system.
