The Verkhovna Rada adopted as a whole as a law Bill 11495 on Amendments to Article 10-1 of the Law “On Social and Legal Protection of Military Personnel and Members of Their Families”.
The aim is to guarantee the right of military personnel to payment of monetary compensation for all unused days of annual basic and additional leave, as well as other types of leave, including additional social leave in the event of dismissal from service during martial law.
Thus, Art. 21 Article 10-1 of the Law “On Social and Legal Protection of Military Personnel and Members of Their Families” is supplemented by a provision stating that unused days of annual basic and additional leave during military service, as well as additional leave for military personnel who have children or an adult child – a person with a disability since childhood of subgroup A of group I, and additional leave provided for in Article 16-2 of the Law “On Leave”, which were not granted to military personnel in a special period from the moment of the announcement of mobilization, are subject to monetary compensation, which is paid in the year of discharge of military personnel from service.
The new wording of paragraph 22 indicates that in the event of the death (death) of military personnel, monetary compensation for all unused days of annual basic and additional leave during military service, as well as additional leave for military personnel who have children or an adult child – a person with a disability since childhood of subgroup A of group I, and additional leave provided for in Article 16-2 of the Law “On Leave”, is paid to the person (persons) specified in the personal order in case of captivity, and in the absence of such an order – to the persons specified in paragraph 6 of Article 9 of this Law, in the manner established by the Cabinet of Ministers of Ukraine, and in the absence of such an order – is included in the inheritance.
This Law shall enter into force one month from the day following the day of its publication.
The Cabinet of Ministers will be required to bring its regulatory legal acts into compliance with this law within one month from the date of publication of this law.
